White-Collar Crimes: The Establishment’s Response to Operation Car Wash

Abstract:

This monographic work analyzed the phenomenon of white-collar corruption in Brazil, its modus operandi and all the agents involved (oranges, civil servants, hidden partners, money changers, lobbyists, politicians), as well as the legislative provisions that led to the establishment’s response in police operations. The focus is on the history of the Lava Jato operation and its legal advances. It was verified in the reaction of the establishment from the changes constructed where the legislator avoided future investigations and promoted the shielding of the political agents to the referred investigation. Finally, anti-corruption legislative proposals are presented with the aim of suggesting viable alternatives to prevent, investigate, punish and recover values diverted from the public purse. For that, the deductive method was used through bibliographic research, in law studies, articles, theses, doctrines and scientific articles.
