Abstract:

The Reflections of Power in the Brazilian Political Sphere and the Legal and Social Aspects in Contemporaneity, consists of the article related to the historical, legal and social context, in which it is directly related to the political and electoral power of the country. Thus, as objectives, the origin and formation of the concept of State, originally portrayed by Machiavelli, is evidenced, being this one the first theoretician to use this nomenclature, in opposition to Aristotelian idealism. It analyzes the evolution and consolidation of the Democratic State of Law, materialized by the Federal Constitution of 1988 and preceded by the Military Regime of 1964. It is directed to the aspects of the corruption, from the colonial time, like way of understanding the current political-partisan moment . Explain about electoral fraud and the evolution of this system. It is found that in other countries there are more punitive punishments for those who commit crimes of corruption. It discusses nuances referring to the principles that guide the theme and the position of scientists, jurists and researchers. Finally, we conclude on the constitutional stability of the last decades; the institutional crisis of the three powers; the use of impeachment as a crisis solution; and the discussion on Political and Electoral Reform in the country.
